Adoption Tax Credit

Adoption tax credit - it's the government's way of lending a helping hand for your adoption expenses. If you qualify, it could help cover up to $12,150 of your adoption expenses.

How it Works

international adoption Let's say you are paid every two weeks and have about $210 in federal taxes automatically deducted from your paycheck. During the course of the year, you finalized an adoption and brought your child home. The adoption cost you $19,000 in expenses, including international and agency fees, travel, lodging and document fees.

When you file your taxes, you would normally owe $12,012 in taxes. Because you've had $10,920 deducted from your biweekly paychecks, you still owe $1,092. But, this year you are able to take an adoption tax credit of up to $12,150 of what you owe - in your case, $12,012. Not only do you not owe that $1,092, but the government will pay you the entire $10,920 that was deducted over the year for federal taxes.

If you have taken out any loans to pay for your adoption, the tax credit is a great way to pay off those loans and become debt free.

A Five Year Benefit

Better still, the adoption tax credit can be spread out over five years. Let's say you typically owe about $6,000 in taxes per year, and your adoption expenses came to a total of $23,000. You can take a tax credit of $6,000 the first three years, and deduct the remaining $5,000 from the taxes you owe the fourth year.

Who Qualifies

For 2009, you cannot take the credit if your modified adjusted gross income was $222,180 or more. If your adjusted gross income was under $182,180, you could take the full tax credit. If your income was between $182,180 and $222,180, the tax credit you can take is gradually phased out.

What Expenses Qualify?

According to the IRS website, expenses that qualify include adoption fees that are "reasonable and necessary," court costs, attorney fees, traveling expenses, meals and lodging during that adoption trip and "other expenses directly related to and for which the principal purpose is the legal adoption of an eligible child."
